Partner Data Agreement

UpNextForYou.org, a United4Youth Project — Terms Governing Partner Organization Data Access

Effective Date: 2026-05-01

This Partner Data Agreement (“Agreement”) governs access to the UpNextForYou.org Platform (“Platform”) by nonprofit partner organizations and their authorized staff. By creating or activating a partner account on the Platform, the registering organization and its authorized representative agree to be bound by this Agreement on behalf of their organization.

This Agreement is presented and accepted at the time of partner account registration. Acceptance is recorded electronically along with the date, the name of the registering representative, and the organization name. Electronic acceptance constitutes a legally binding agreement.

1. Who This Agreement Applies To

This Agreement applies to:

  • Nonprofit organizations and their authorized staff who are granted partner-level access to the Platform
  • Any staff member of a partner organization who creates an account under that organization’s partner credentials

Each staff member who creates an account also agrees individually to the Platform’s Terms and Conditions and Acceptable Use Policy.

2. Authorized Purpose

Partner organizations may access youth participant data through the Platform solely for the following purposes:

  • Identifying youth who may benefit from the partner’s programs or services
  • Communicating with matched or referred youth participants through Platform tools
  • Submitting referrals and program enrollment information on behalf of youth participants
  • Coordinating services with JIT and United4Youth program staff

Partners may not use Platform data for any commercial, marketing, fundraising, research, or other purpose outside of direct service delivery.

3. Data Access Restrictions

  • Partner staff may only access data for youth participants who have been matched, referred, or assigned to their organization through the Platform
  • Partner organizations may not download, export, or transfer youth data to external systems without prior written authorization from JIT/United4Youth
  • Partner organizations may not share youth data with any third party without explicit written consent from the youth participant and from JIT/United4Youth
  • Only authorized staff members may hold active Platform accounts under the partner organization’s credentials
  • Partner organizations must notify JIT/United4Youth immediately when a staff member leaves or is no longer authorized, and must ensure that staff member’s account is deactivated promptly

4. Data Security

  • Partner staff must access the Platform only from secure, password-protected devices
  • Login credentials must not be shared between staff members
  • Any suspected data security incident must be reported to JIT/United4Youth within 24 hours of discovery at: admin@upnextforyou.org
  • Partners must cooperate fully with any security incident investigation

5. Confidentiality

All youth participant information accessed through the Platform is confidential. Partner organizations agree to:

  • Treat all youth data as strictly confidential and limit access to staff with a legitimate need to know
  • Not discuss or disclose identifiable youth information in any public setting, on social media, or with unauthorized persons
  • Ensure all staff with Platform access understand and comply with these confidentiality obligations

6. Children’s Privacy

The Platform is intended for youth participants 18 years of age and older. Where a partner organization submits a referral for a youth participant, the partner organization represents and warrants that it has verified the participant’s eligibility and, where required by law, obtained any necessary parental or guardian consent prior to submission.

7. Compliance with Law

Partner organizations agree to comply with all applicable laws in connection with their use of the Platform, including but not limited to applicable privacy laws, child welfare regulations, and any laws governing the handling of sensitive personal information.

8. Term and Termination

This Agreement remains in effect for as long as the partner organization maintains an active account on the Platform. JIT/United4Youth may suspend or terminate a partner organization’s access at any time for violation of this Agreement, the Platform’s Terms and Conditions, or applicable law. Upon termination, the partner organization must immediately cease all access to youth data and destroy or return any copies of youth data held outside the Platform.

9. Amendments

JIT/United4Youth may update this Agreement from time to time. Partner organizations will be notified of material changes and continued use of the Platform will constitute acceptance of the updated Agreement.

10. Governing Law

This Agreement is governed by the laws of the State of California. Any disputes shall be subject to the exclusive jurisdiction of courts in San Diego County, California.
