Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the UpNextForYou.org web application (“Platform”), operated by United4Youth and Just in Time for Foster Youth (“JIT”), a California nonprofit corporation. By registering for or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

UpNextForYou.org, a United4Youth project (“UNFY”), is a web-based platform designed to connect current and former foster youth with resources, mentors, community organizations, and opportunities to support their transition to self-sufficiency. It is one component of a broader collaborative initiative involving JIT and its partner organizations.

2. Eligibility and User Accounts

2.1 Who May Use the Platform

The Platform is available to:

• Current or former foster youth (generally ages 18–26, or as otherwise determined by applicable program guidelines)
• Volunteer mentors, coaches, and community supporters who have been vetted and approved through the Platform’s onboarding process
• Nonprofit partner organizations and their authorized staff
• Administrators operating on behalf of JIT, United4Youth, or a partner organization

2.2 Age Requirement

The Platform is intended for users who are 18 years of age or older. We do not knowingly collect personal information from children under 13.

2.3 Account Registration

You must create an account to access most features of the Platform. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

2.4 Email Verification

All accounts require email verification before access is granted. Unverified accounts will not have access to Platform features.

3. Acceptable Use

3.1 Permitted Uses

You may use the Platform to create and maintain a personal profile; connect with mentors, volunteers, and partner organizations; access resources, program information, and events; communicate through Platform-provided messaging features; and participate in onboarding, intake, and program-related workflows.

3.2 Prohibited Conduct

You agree NOT to:

• Use the Platform for any unlawful purpose or in violation of applicable laws
• Harass, threaten, or harm other users
• Share false, misleading, or fraudulent information
• Attempt to gain unauthorized access to other accounts or Platform systems
• Scrape, copy, or reproduce Platform content without written permission
• Upload malware, viruses, or harmful code
• Use the Platform to solicit, advertise, or conduct unauthorized commercial activity
• Impersonate any person, organization, or Platform role

4. User-Generated Content

You retain ownership of content you submit to the Platform. By submitting content, you grant UNFY and JIT a non-exclusive, royalty-free license to use, store, and display that content solely for the purpose of operating and improving the Platform. We do not sell your content to third parties. We reserve the right to remove content that violates these Terms or applicable law.

5. Privacy and Data

Your use of the Platform is also governed by our Privacy Policy, incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in that policy.

6. Platform Analytics and Session Recording

The Platform uses PostHog for product analytics and session replay. Session replay captures anonymized user interactions to help us improve usability. Personally identifiable information inputs (such as passwords and sensitive form fields) are masked in recordings. By using the Platform, you consent to this data collection as further described in our Cookie and Analytics Policy.

7. Third-Party Services

The Platform integrates with third-party services including Supabase (database and authentication), Resend (email delivery), Cloudflare Turnstile (security), PostHog (analytics and session replay), Sentry (error monitoring), and Vercel (hosting). Your use of those services is also governed by their respective terms and privacy policies.

8. Partner Organizations

Organizations that access youth data through the Platform agree to the Partner Data Agreement at the time of account creation. Partner staff are bound by the terms of that agreement and applicable law.

9. Intellectual Property

All Platform content, branding, logos, software, and design elements are owned by or licensed to United4Youth and/or Just in Time for Foster Youth. You may not copy, reproduce, modify, or distribute any Platform content without express written permission.

10. Platform Availability and Changes

We strive to maintain reliable access to the Platform but do not guarantee uninterrupted availability. We may update, modify, suspend, or discontinue the Platform at any time. We will make reasonable efforts to notify registered users of material changes.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNFY, UNITED4YOUTH, AND JUST IN TIME FOR FOSTER YOUTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT PAID (IF ANY) IN THE 12 MONTHS PRIOR TO THE CLAIM.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or at our discretion. You may request account closure by contacting us. Provisions that by their nature survive termination shall do so.

14. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be subject to the exclusive jurisdiction of courts in San Diego County, California.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. We will notify registered users of material changes.
